Well I was cheering on the raids of quinceaΓ±eras and the deportation of millions of 15 year old hispanic girls and their babies until this lovely, totally reasonable lady and her tattoos and facial expressions showed me the error of my ways. π₯Justice Clarence Thomas penned a forceful concurrence Wednesday criticizing "self-described experts" as constitutionally "irrelevant" as the Supreme Court upheld Tennessee's ban on certain medical treatments for transgender minors in a 6-3 ruling.
While the majority in U.S. v. Skrmetti found Tennessee's SB1 satisfied rational basis review under the Equal Protection Clause, Thomas used his concurrence to deliver a broader critique of deference to medical expertise in constitutional interpretation.
"The views of self-proclaimed experts do not 'shed light on the meaning of the Constitution,'" Thomas wrote, citing the Dobbs abortion decision. "Whether 'major medical organizations' agree with the result of Tennessee's democratic process is irrelevant."
Thomas specifically targeted the term "gender-affirming care" as a "sanitized description" that "obscures the nature of the medical interventions at issue." He emphasized that "the American people and their representatives are entitled to disagree with those who hold themselves out as experts" and praised Tennessee citizens' "right to decide for themselves."
