ФНС все чаще переквалифицирует отношения с тренерами-самозанятыми в трудовые. Например, в деле А04-5462/2023 суд поддержал инспекцию, которая доначислила фитнес-центру страховые взносы и НДФЛ на 3,6 млн рублей.
Услуги тренеров носили систематический характер, оплата поступала регулярно, а оборудование для занятий предоставлялось фитнес-центром. Дополнительно инспекция изучила соцсети и провела допросы, где тренера-самозанятые называли клуб местом работы.
Вывод: фитнес-клубам нужно анализировать все риски работы с ИП и самозанятыми, потому что налоговые органы знают о сложившейся практике оформления отношений с тренерами.
