(Кстати, забавно, что в определении коллегия подробно пересказывает позицию апелляции, которая пишет, что договорное преимущественное право признается в практике кассационного суда, этой практике надо непременно следовать. Кажется, вот-вот они напишут - но ведь в России не прецеНдетное право!).
