ВС рассмотрит спор о двойной ответственности руководителя в банкротстве
В рамках банкротства общества «МТК» его КУ Сергей Иванников обратился в суд с заявлением о привлечении бывшего руководителя общества Олега Москвина к субсидиарной ответственности. Управляющий указал, что Москвин в 2016-2018 годах необоснованно снял с расчетного счета компании более 9 млн рублей наличными. Суды трех инстанций отказали в привлечении Москвина к «субсидиарке», но взыскали с него около 8,3 млн рублей убытков.
Москвин подал кассационную жалобу в ВС, указав на двойную ответственность и тождественность оснований привлечения его к ней. Он также заявил, что производство по заявлению нужно было прекратить.

They may also impersonate or clone licensed capital market intermediaries by using the names, logos, credentials, websites and other details of the legitimate entities to promote the illegal schemes.
