Under the Sebi Act, the regulator has the power to carry out search and seizure of books, registers, documents including electronics and digital devices from any person associated with the securities market. As the war in Ukraine rages, the messaging app Telegram has emerged as the go-to place for unfiltered live war updates for both Ukrainian refugees and increasingly isolated Russians alike. The initial signals were promising, especially given Telegram’s user base is already fairly crypto-savvy. Unfortunately, third-party sales of coins bought in those initial fundraising rounds raised the ire of the SEC, which brought the hammer down on the whole operation. In 2020, officials ordered Telegram to pay a fine of $18.5 million and hand back much of the cash that it had raised. Perpetrators of such fraud use various marketing techniques to attract subscribers on their social media channels. But Kliuchnikov, the Ukranian now in France, said he will use Signal or WhatsApp for sensitive conversations, but questions around privacy on Telegram do not give him pause when it comes to sharing information about the war.
