По его словам, сотрудник таможенной службы проверил документы и признал, что они в порядке, но автомобиль все равно арестовали, так как «с октября 2022 года въезд автомобилей с номерами РФ в ЕС запрещен».
«На мой взгляд, здесь мы имеем дело с эксцессом исполнителя, — сказал РБК адвокат, партнер BGP Litigation Сергей Гландин. — Власти Германии простой ввоз автомобиля на территорию Евросоюза почему-то посчитали экспортом. Но экспорт — это несколько другая история, это когда человек приезжает на территорию другой страны и хочет там ее продать». Случаи ареста автомобилей у физлиц — эксцесс исполнителя и проявление «очень оригинальной трактовки европейских санкций», считает доцент департамента международного права НИУ ВШЭ Владислав Старженецкий.
