Верховный Суд РФ в Определении от 20.02.2025 №305-ЭС24-10389 по делу №А41-27292/2019 указал, что завершение конкурсного производства в отношении должника не является препятствием для рассмотрения регрессного требования сопоручителя, поскольку определение размера доли сопоручителя к одному из солидарных должников, очередности удовлетворения его требования и уменьшение требования кредитора по основному обязательству в реестре имеют значение как для разрешения аналогичных требований к другим сопоручителям, так и в случаях рассмотрения спора о привлечении к субсидиарной ответственности контролирующих должника лиц и открытия процедуры распределения вновь обнаруженного имущества.
