ВС РФ решил, когда сверхнормативные потери в электросетях могут быть учтены сетевой организацией при уплате налога на прибыль (см. определение от 27.09.2024 № 308-ЭС24-9158).
В частности, из определения СКЭС ВС РФ следует, что стоимость всех фактических потерь электрической энергии, не дошедшей до потребителей (в том числе связанных с безучетным и несанкционированным потреблением электроэнергии третьими лицами), может быть включена в состав материальных расходов при определении размера налога на прибыль организаций лишь при экономической оправданности заявленных налогоплательщиком расходов.
