Минимальный срок владения недвижимостью не играет роли, если она использовалась в предпринимательской деятельности. В этом случае доход от НДФЛ не освобождается.
Но это ограничение не применяется к жилой недвижимости.
Поэтому если самозанятый владел квартирой более 5 лет (или в ряде случаев — 3 года), он не будет платить НДФЛ при ее продаже. То, что ранее он сдавал эту квартиру в аренду, значения не имеет.
