Ранее ФАС признала саморегулируемую организацию (СРО) нарушившей антимонопольное законодательство.
❌ В документах организации содержались нормы, согласно которым к реализации имущества привлекаются только аккредитованные в Союзе «Созидание» организаторы торгов, операторы электронных площадок и иные лица.
❗ Это исключало возможность привлечения к торгам добросовестных лиц, аккредитованных в других СРО.
📃 ФАС выдала «Созиданию» предписание о прекращении незаконной координации экономической деятельности. Организация также должна была исключить из своих локальных актов соответствующие положения.
СРО арбитражных управляющих обжаловала решение и предписание ведомства в судебном порядке, однако Арбитражный суд города Москвы и Девятый арбитражный апелляционный суд поддержали позицию службы, признав ее обоснованной. #суды
