Прекращение одобренной Конгрессом помощи Украине является незаконным в соответствии с положениями Закона о контроле за изъятием средств (Impoundment Control Act) 1974 года. Такое решение также является неконституционным, так как согласно Конституции США Конгресс, а не президент, имеет полномочия устанавливать государственные расходы и принимать законы. Задача президента в том, чтобы «заботиться о том, чтобы законы добросовестно исполнялись».
И именно за аналогичное изъятие выделенных Конгрессом средств для Украины, чтобы надавить на Зеленского, и он повлиял на выборы 2020 года в США, Палата представителей объявила импичмент Трампу в 2019 году. Теперь Трамп решил повторить атаку, на этот раз уже публично, демонстрируя свою решимость действовать так, как он хочет, независимо от законов и Конституции.
Впрочем решать американскому народу, Конгрессу и судебной системе. Нам остается наблюдать.
