Щаникова пыталась добиться в Пенсионном фонде выплат, положенных при потере кормильца, но ей отказали — как и в нижестоящих судах. Решение объяснили статьей закона «О страховых пенсиях», в которой говорилось, что на пенсию могут рассчитывать только члены семьи, состоявшие на иждивении умершего кормильца. Поскольку муж Марии Щаниковой умер до зачатия, судьи решили, что это условие не выполнялось.
Мария Щаникова обратилась в Конституционный суд в январе 2024 года. Спустя более чем год суд признал положения 10-й статьи закона «О страховых пенсиях» несоответствующими Конституции.
