На днях Октябрьский районный суд Тамбова вернул в прокуратуру уголовное дело троих студентов колледжа автотранспорта, которые в январе этого года выложили в Сеть видео своих издевательств и убийства домашнего кота.
Дело в том, что суд считает, что в прокуратуре некорректно составили обвинительное заключение, что создало препятствия для вынесения приговора. А конкретно: привлечение одного из фигурантов к административной ответственности по статье 6.10 КоАП РФ (Вовлечение несовершеннолетнего в употребление алкогольной продукции) мешает осудить его по части 1 статьи 151 УК РФ
Верховный суд РФ считает, что в таком случае по делу о привлечении к административной ответственности должно быть прекращено, а постановление о назначении административного наказания необходимо отменить.
