До сих пор в пункте 1.1. статьи 42 218-ФЗ о госрегистрации недвижимости предусмотрены некоторые исключения для нотариальной формы договора. Например, за исключением:
👉"сделокпри отчуждении или ипотеке всеми участниками долевой собственности своих долей по одной сделке".
Чтобы исключить разночтения, в Госдуму внесли еще один законопроект, в котором данный пункт предложили уточнить, указав, что правила исключения применяются, «еслииное не установлено Гражданским кодексом Российской Федерации».
