لا نظر إلى القائلين من المجتهدين بل إلى أقوالهم ومداركها قوة وضعفًا، ونعني بالقوة ما يوجب وقوف الذهن عندها وتعلق ذي الفطنة بسبيلها لانتهاض الحجة بها؛ فإن الحجة لو انتهضت بها لما كنا مخالفين لها.
إذا عرفت هذا فمن قوي مدركه اعتد بخلافه وإن كانت مرتبته [في الاجتهاد] دون مرتبة مخالفه، ومن ضعف مدركه لم يعتد بخلافه وإن كانت مرتبته أرفع، وربما قوي مدرك بعضهم في بعض المسائل دون بعض؛ بل هذا لا يخلو عنه مجتهد.
