В постановлении говорится, что президент неподсуден только за действия, совершенные им в официальном качестве, но часть из того, что ему инкриминируется, под это определение может не подпадать.
Трамп настаивает на том, что его нельзя судить за действия, относящиеся к периоду его пребывания в должности президента США, включая центральный эпизод процесса – штурм Капитолия его сторонниками 6 января 2021 года в попытке сорвать утверждение конгрессом победы на президентских выборах его конкурента-демократа Джо Байдена.
