По версии надзора, 52% долей СП ООО «Сахалин-Шельф-Сервис» ответчики владеют незаконно, так как являются иностранными резидентами. Владельцем же бизнеса господин Богданчиков, по данным прокуроров, стал, используя свое служебное положение — доли государства, оцениваемые в 900 млн руб., согласно его директивам, были проданы всего за 44 тыс. руб.
На данный момент надзорное ведомство помимо расторжения сделок требует обратить в доход государства подконтрольные господам Богданчикову и Гарберу доли в СП.
