Истца ООО «Союз Святого Иоанна Воина» товарные знаки интересуют в отношении части товаров единственного класса МКТУ. Бренды ответчика – итальянской компании S.A.C.R.A. S.r.l. – в этом классе зарегистрированы для таких товаров, как кофе, чай, хлеб, кондитерские изделия, мороженое, соусы и т.д.
Один из двух идентичных брендов был оформлен итальянской компанией в 1997 г., второй – в 2007 г., правовая охрана обоих сейчас действует до 2027 г. Товарные знаки распространяются на четыре класса товаров, включающие также мыло, косметику, чашки, тарелки, алкогольные напитки, и два класса услуг, включая организацию продаж.
