❗️Арбитражный суд Москвы принял к рассмотрению заявление столичного АО «Гео-Система» о банкротстве крупного европейского депозитария Euroclear Bank
Заявление поступило в суд 19 августа. Проверка его обоснованности назначена на 21 ноября. В карточке дела не указана сумма задолженности бельгийского банка перед заявителем. Однако известно, что арбитражный суд Москвы в марте взыскал с Euroclear Bank ~$1,2 млн убытков по иску АО «Гео-Система».
Истец является владельцем еврооблигаций эмитентов «Полюс Золото», «Норильский никель», «Евраз» и «Газпромнефть». Ценные бумаги до мая 2022 г. были погашены и по ним эмитентами выплачены купонные доходы, но все выплаты зависли на заблокированных счетах Национального расчетного депозитария в Euroclear Bank.
Суд удовлетворил иск АО «Гео-Система» о взыскании убытков в размере замороженных средств. Решение вступило в силу в июле, когда Девятый арбитражный апелляционный суд отклонил жалобу ответчика на него. At the start of 2018, the company attempted to launch an Initial Coin Offering (ICO) which would enable it to enable payments (and earn the cash that comes from doing so). The initial signals were promising, especially given Telegram’s user base is already fairly crypto-savvy. It raised an initial tranche of cash – worth more than a billion dollars – to help develop the coin before opening sales to the public. Unfortunately, third-party sales of coins bought in those initial fundraising rounds raised the ire of the SEC, which brought the hammer down on the whole operation. In 2020, officials ordered Telegram to pay a fine of $18.5 million and hand back much of the cash that it had raised. There was another possible development: Reuters also reported that Ukraine said that Belarus could soon join the invasion of Ukraine. However, the AFP, citing a Pentagon official, said the U.S. hasn’t yet seen evidence that Belarusian troops are in Ukraine. On February 27th, Durov posted that Channels were becoming a source of unverified information and that the company lacks the ability to check on their veracity. In the United States, Telegram's lower public profile has helped it mostly avoid high level scrutiny from Congress, but it has not gone unnoticed. Oleksandra Matviichuk, a Kyiv-based lawyer and head of the Center for Civil Liberties, called Durov’s position "very weak," and urged concrete improvements.
