Мы следим за деломTornado Cash о признании незаконным решения OFAC о введений санкций против этой площадки. 17 августа ⚖️ техасский федеральный суд 🇺🇸 отказал истцам в иске. Отметим 2 главных вывода:
1️⃣Tornado Cash можно приравнять к «организации» для целей введения санкций по закону IEEPA. Добавляя в SDN опенсорсный программный код, Минфин не превысил своих полномочий 2️⃣ Смарт-контракты, заключенные на площадке Tornado Cash, также входят в понятие «собственность», на что в соответствии с нормативными разъяснениями OFAC распространяются санкции США
Миксер Tornado Cash был внесён в SDN 8 августа прошлого года. С этим не согласились многие в крипто-сообществе. Было подано несколько исков о признании решения регулятора незаконным по причине нарушения закрепленного в Первой поправке – права пользователей на свободу слова.

At its heart, Telegram is little more than a messaging app like WhatsApp or Signal. But it also offers open channels that enable a single user, or a group of users, to communicate with large numbers in a method similar to a Twitter account. This has proven to be both a blessing and a curse for Telegram and its users, since these channels can be used for both good and ill. Right now, as Wired reports, the app is a key way for Ukrainians to receive updates from the government during the invasion. "The inflation fire was already hot and now with war-driven inflation added to the mix, it will grow even hotter, setting off a scramble by the world’s central banks to pull back their stimulus earlier than expected," Chris Rupkey, chief economist at FWDBONDS, wrote in an email. "A spike in inflation rates has preceded economic recessions historically and this time prices have soared to levels that once again pose a threat to growth." Messages are not fully encrypted by default. That means the company could, in theory, access the content of the messages, or be forced to hand over the data at the request of a government. On December 23rd, 2020, Pavel Durov posted to his channel that the company would need to start generating revenue. In early 2021, he added that any advertising on the platform would not use user data for targeting, and that it would be focused on “large one-to-many channels.” He pledged that ads would be “non-intrusive” and that most users would simply not notice any change. These entities are reportedly operating nine Telegram channels with more than five million subscribers to whom they were making recommendations on selected listed scrips. Such recommendations induced the investors to deal in the said scrips, thereby creating artificial volume and price rise.
