На прошлой неделе обсуждали в Сбере банкротную реабилитацию…📈
ИМХО, сейчас сложилась ситуация, когда реабилитация в банкротстве это:
✔️ долго
✔️ дорого
✔️ под конкретного инвестора
…а значит, как справедливо заметил Андрей Смирных, крайне редко🤷♂️
P.S.: чтобы реабилитация заработала, нашему правопорядку нужно научиться сохранять должника во владении, предоставить инвестору в процедуре реструктуризационную привилегию и наконец легализовать cram-down в корпоративных банкротствах, без этого имеем, что имеем…
