В преддверии завтрашнего обсуждения - результаты опроса, который я проводил чуть ранее, ИМХО, подтверждают лишь то, что пока ничего с тем КАК технически будет сниматься арест непонятно🤷♂️
То, что банкротчики придерживаются идеи автоматического снятия так же очевидно, как и то, что это в своем роде wishful thinking, увы.
Это, конечно, никак не обесценивает позицию ВС - то что было повторена позиция КС само по себе крайне важно, но видимо, придется подождать какого-нибудь спора по главе 24 АПК об отказе, к примеру, Росреестра снимать ограничения., который дойдет до ВС.
P.S.: отдельный вопрос - а что с res judicata, если арест наложен судом? Относительная сила судебных актов в банкротстве так и не летает у нас до сих пор…
