Что знаем? Владелец электроустановки получил штраф 20 тысяч рублей за нарушение по установке. И в суде не смог оспорить штраф за несоблюдение требований по заземлению оборудования. Но мог бы! - Если бы знал про письмо Минэнерго РФ, где разъяснили, что правила не являются обязательными.
Как аргументировать? КоАП РФ действительно предусматривает штраф от 20 до 40 тысяч рублей за нарушение правил устройства электроустановок. При этом ПУЭ, утвержденные приказом Минэнерго РФ N 204 не были зарегистрированы Минюстом России. И соответственно не являются обязательными - об этом указано в письме Минэнерго РФ. Поэтому штрафы за нарушение ПЭУ являются незаконными.
