1. Закон регулирует правоотношения, возникшие с 24.02.2022 г. То есть добровольцы 2014-2021 гг. в пролёте.
2. Правоотношения начинаются с момента подписания контракта.
3. Документ по сути легализует российские частные военные компании, вводит их в российскоеправовое поле.
Знаменательно, но сегодня на Grey Zone как раз задавали вопрос, не привлекут ли «оркестрантов» по ст. 359 УК РФ («Наёмничество»). Нет, не привлекут, новый закон «О добровольцах» (а точнее ряд поправок) все это легализует,
С другой стороны, сугубо моё ИМХО, в России нет и не будет #ЧВК в том виде, какие они существуют зарубежом. А вот почему — будет в статье, которую я, наконец, дописываю. 😉
