Соловцова по 5 пункту Пленума N 40 (если, конечно , я правильно понял ) : если требование кредитора менее 2 млн., но активов у должника нет , то даже если суд не прекратил рассмотрение дела в связи отсутствием средств на процедуру , необходимо давать право на субсидиарку вне рамок дела .
