ФНС в письме от 10.01.2025 № БВ-4-7/58@ уточнила, что истребовать документы можно не только у первого контрагента проверяемого налогоплательщика, но и у последующих участников цепочки сделок. Это не противоречит пункту 1 статьи 93.1 НК РФ.
Однако требование должно содержать чёткую цепочку контрагентов и связь документов с проверяемым налогоплательщиком. Если такой информации нет, требование может быть признано незаконным.
