Заявитель АО «Эйч энд Эн» (англоязычная версия названия – Heаlth & Nutrition (H&N) просит признать незаконным решение инспекции ФНС от 15 января 2024 г. в части доначисления ей за 2021 г. ~742 млн руб налога с доходов, полученных иностранной организацией в виде дивидендов от источников в РФ.
Оспаривается также налог с доходов, полученных иностранной организацией в качестве вознаграждения за услуги и переквалифицированных в дивиденды: за 2020 г. это >41 млн руб, за 2021 г. ~53 млн руб. Кроме того, АО «Эйч энд Эн» оспаривает соответствующие суммы пени и штрафов.
В июле 2023 г. Путин подписал указ, по которому доля французской компании в АО «Данон Россия» перешла во временное управление Росимущества. В сентябре Danone была переименована в «Эйч энд Эн». Danone работал в РФ с 1992 года, его бренды – «Простоквашино», «АктиБио», Actimel, Alpro, «Растишка», «Тёма», «Даниссимо» и др. ⬇️ А40-142914/2024
