Доводы нашей жалобы были основаны на несоответствии выводов судов имеющимся в деле доказательствам (да, такое основание для отмены в Верховном Суде существует).
Казалось бы, что сложно, суды не дали оценку существенным доказательствам. Такие дела судьи слушают по 5 минут, некоторые даже за 1 умудряются в 9ААС.
Однако целый час стороны выступали, судьи активно задавали вопросы и пытались вникнуть во всю картину спора (с учетом споров в других обособках).
По результату – жалоба удовлетворена. Дело отправлено на новое рассмотрение в первую инстанцию.
