Частично соглашусь с Ириной Анатольевной: КС и правда не решил все проблемы отношений между вузом и преподавателям, которые мы поднимали. Тем не менее, важно помнить: жалоба всегда запрашивает больше, чем КС иногда может сделать (учитывая обстоятельства 😉).
Коммерсанту я объяснил это немного поэтически:
«Однако сам факт вынесения постановления по делу Ирины Алебастровой после «дела Подакова» уже говорит о том, что проблема отношений между вузом и преподавателем не решается на системном уровне, добавляет юрист: КС вынужден как бы «подчищать» законодательные огрехи, быть «жнецом, швецом и кузнецом в одночасье»
Так что в любом случае — это победа в Конституционном Суде. Победа академических свобод.
