22.06.2024 Горбунов был задержан в порядке ст.91 УПК РФ. Обвинение не предъявлялось. 23.06.2024 Горбунову был продлен срок задержания на 72 часа.
Горбунов и защитник возражали, просили домашний арест, залог или запрет определённых действий.
Суд ходатайство следствия удовлетворил, избрав Горбунову стражу 20.08.2024.

Russians and Ukrainians are both prolific users of Telegram. They rely on the app for channels that act as newsfeeds, group chats (both public and private), and one-to-one communication. Since the Russian invasion of Ukraine, Telegram has remained an important lifeline for both Russians and Ukrainians, as a way of staying aware of the latest news and keeping in touch with loved ones. "There is a significant risk of insider threat or hacking of Telegram systems that could expose all of these chats to the Russian government," said Eva Galperin with the Electronic Frontier Foundation, which has called for Telegram to improve its privacy practices. "Someone posing as a Ukrainian citizen just joins the chat and starts spreading misinformation, or gathers data, like the location of shelters," Tsekhanovska said, noting how false messages have urged Ukrainians to turn off their phones at a specific time of night, citing cybersafety. The War on Fakes channel has repeatedly attempted to push conspiracies that footage from Ukraine is somehow being falsified. One post on the channel from February 24 claimed without evidence that a widely viewed photo of a Ukrainian woman injured in an airstrike in the city of Chuhuiv was doctored and that the woman was seen in a different photo days later without injuries. The post, which has over 600,000 views, also baselessly claimed that the woman's blood was actually makeup or grape juice. But Telegram says people want to keep their chat history when they get a new phone, and they like having a data backup that will sync their chats across multiple devices. And that is why they let people choose whether they want their messages to be encrypted or not. When not turned on, though, chats are stored on Telegram's services, which are scattered throughout the world. But it has "disclosed 0 bytes of user data to third parties, including governments," Telegram states on its website.
