30 января Верховный Суд вынес Определение № 308-ЭС22-27464 (11,13,14) по делу № А63-6153/2019, в котором рассмотрел спор об утверждении мирового соглашения в рамках дела о банкротстве.
Суд отметил, что мировое соглашение, имеющее реабилитационную направленность, должно быть утверждено, если его исполнимость находится вне всяких сомнений, а также когда его успешная реализация скорее будет иметь место, чем нет.
Эксперты «АГ» положительно оценили позицию ВС, отметив, что Суд провозглашает приоритет реабилитационных процедур перед конкурсными и формулирует стандарт доказывания возможности исполнения реабилитационного мирового соглашения.
