Ужасную историю рассказали недавно в чате канала. Жители решили поменять способ управления домом - с кооператива "от застройщика" на стороннюю управляющую организацию. У них не вышло: суд решил, что чтобы сменить способ управления (способ управления в целом, Карл! Не управляшку!), надо доказать, что кооператив плохо работал 🤷♀️ по некому договору управлению 🤦♀
И это безобразие из Красноярска не отменил даже Верховный Суд, и не помогла жалоба в Конституционный Суд РФ.
Из-за этой истории я ещё раз полезла перепроверить практику судов о смене самих управляющих организаций между собой (первый раз было здесь).
Написала пост об этом. Пусть вас не смущает обилие практики в пользу жителей. Она не гарантирует защиту от тёмной магии судов как в случае подписчика.
