Показательно, что почти вся аргументация ВС в деле Захаровой о допустимости судебного преодоления (кроме единственного жилья) никак не привязана к виду должника - гражданин или организация, в т.ч. ст. 10 ГК. Хочется надеяться, что судебная практика услышит в этом призыв и скоро мы увидим такое преодоление и в деле о банкротстве организации
