Суд прямым текстом сказал, что личная явка не обязательна, а необходимость привлечения к административной ответственности заявителя не состоит в прямой связи с обязанностью военкомата снять его с учёта. Проще говоря, мухи отдельно, котлеты отдельно. Если хотите привлечь - привлекайте, но с учёта снять обязаны.
