التَّخيير الفقهي من حجج المُصوِّبة، وهو من آثار القول بالتَّصويب ولوازمه، فالأصل أنَّ مَنْ صوَّب خَيَّر، كما أنّ الأصل أنَّ من خَطَّأ؛ لم يُخيِّرْ.. على أنَّ من المُصوِّبة من لا يُخيِّر، وهذه مفارقة للأصل. كما أنَّ من المُخطِّئة من يُخيِّر، وهذا يشبه أن يكون مفارقا لأصله أو متناقضا فيه؛ إذ الأصل بطلان التخيير بين الصواب والخطأ وإن لم يكن مُعيَّنا. فحاصله: أنَّ مَنْ قال بالتَّخيير من المُخطِّئة؛ فارق أصله وناقضه. ومَنْ منع التَّخيير من المُصوِّبة؛ فارق أصله وناقضه أيضا.
