فمن حقّ العالمِ بالتشريعِ أن يخبُرَ أفانينَ هذه المصالح في ذاتها، وفي عوارضها، وأن يسبر الحدود والغايات التي لاحظتها الشريعة في أمثالها وأحوالها، إثباتا ورفعا، واعتدادا ورفضا، لتكون له دستورًا يُقتدى، وإمامًا يحتذى، إذ ليس له مطمع -عند عروض كل النوازل النازلة، والنوائب العارضة- بأن يظفر لها بأصلٍ مماثلٍ في الشريعة المنصوصة، ليقيس عليها، بله* نصٍّ مقنعٍ يفيء إليه، فإذا عنّت للأمة حاجةٌ، وهرع الناسُ إليه يتطلّبون قولَه الفصلَ فينا يقدِمون عليه؛ وجدوه ذكيَّ القلبِ، صارم القول، غير كسلانٍ ولا متبلِّد.
