قال الربيع بن سليمان، عقب ذلك: " هذه المسألة فيها غلط؛ لأن الشافعي يقول: لا يجوز نكاح المحرمة ولا المحرم. فلما أهلت هذه بحج، ثم نكحت: كان نكاحها باطلا. ولم يكن لها زوج يمنعها، وتمضي في حجها. وليس لها زوج تلزمه النفقة لها؛ لأنها ليست في أحكام الزوجات. ولعل الشافعي إنما حكى هذا القول في قول من يجيز نكاح المحرم. فأما قوله: فإنه لا يجوز نكاح المحرم ولا المحرمة..". اهـ.
