Согласно проекту Минцифры, поводом для проверки может стать наличие у Роскомнадзора сведений о трансграничной передаче персональных данных и финансовой информации (например, платежных документах, данных о денежных переводах, информации о вкладах граждан), при условии, если:
🔸Роскомнадзор знает о двух и более случаях такой трансграничной передачи ПД в течение одного календарного года,
🔸Данные передавались (1) оператором, который не уведомлял Роскомнадзор о трансграничной передаче, и (2) при помощи программных средств, владельцем которых является иностранное ЮЛ или ФЛ.
⏳Проект Минцифры может быть принят уже в ближайшее время — сейчас он находится на стадии общественных обсуждений.
