Пленум ВС одобрил законодательную инициативу о признании утратившей силу ч. 3 ст. 114 ГПК РФ, которая обязывает суд направлять ответчику копию искового заявления вместе с судебной повесткой, а истцу – копию объяснений ответчика (при их наличии).
Кроме того, предлагается аннулировать ч. 3 ст. 238 ГПК РФ, освобождающую от уплаты госпошлины при подаче заявления об отмене заочного решения суда. После изменений в Налоговый кодекс, вступивших в силу с 8 сентября, при подаче такого заявления госпошлина составляет 1500 рублей.
Поправки будут внесены в Госдуму в качестве дополнения к законопроекту о передаче апелляционной инстанции полномочий по проверке апелляционных жалоб. Документ уже прошел первое чтение.
