В заявлении, поданном бывшим прокурором, констатировалось, что в первые месяцы пандемии COVID Пекин скрывал данные о существовании и распространении вируса и препятствовал производству в других странах, а также закупке и экспорту критически важного медицинского оборудования, включая средства индивидуальной защиты (СИЗ).
В решении судьи говорится, что «Китай вводил мир в заблуждение» относительно опасности и масштабов пандемии и «занимался действиями, ведущими к монополии» в сфере производства СИЗ. Из-за этого, пришел к выводу судья, США не смогли вовремя отреагировать на распространение вируса и закупить достаточное количество оборудования.
