Как и ожидалось (почти без надежды на иной результат), Роспатент не нашел у себя полномочий устанавливать подделку подписи на письме-согласии и, соответсвенно, его фальсификацию.
Предоставление нами заключения специалиста-подчерковеда из экспертной организации и тот факт, что получивший наше возражение правообладатель свою позицию не представил и наши обвинения не отверг, не помогли. Члены коллегии все равно развели руками и сказали: мы не уполномочены 🤷♂️
Регистрация товарного знака, полученная по поддельному согласию от моего доверителя, пока оставлена в силе.
Отменена она будет только Судом по интеллектуальным правам в рамках процедуры оспаривания решения Роспатента.
