На днях суд залил на сайт текст апелляционного определения по каршерингу (и нам и им отказали по итогу). Я почитал, и мне оно очень не понравилось.
Основные тезисы:
- клиент сам дурак, что с таким условием штрафа согласился, его никто не заставлял 🤡 - клиент должен был доказать несоразмерность штрафа (хотели снизить с 50 тысяч до 5 тысяч), хотя закон обязывает это делать, если ты ИП или юрлицо, к физикам это не относится
Суд посчитал, что размер штрафа за провоз стремянки в машине, законный и обоснованный, хотя никто не пострадал, имущество не повреждено.
План тот же: обжалуем, пока есть возможность обжалования. Т.е. впереди еще кассация и верховный суд.
