📄 بخشنامه سازمان امور دانشجویان مربوط به افزایش هزینه‌ لغو تعهد خدمت آموزش رایگان با قواعد فقهی زیر مغایرت دارد:
▬ لاضرر و لاضرار فی الاسلام
▬ قبح عقاب بلابیان
▬ نفی عسر و حرج
▬ العقود تابعه القصود
▬ المؤمنون عند شروطهم
▬ اوفوا بالعقود
▬ احترام مال مسلمان
▬ اکل مال به باطل

⚖ فقهای شورای نگهبان نیز در استعلام‌های متعدد دیوان عدالت اداری اعلام کرده‌اند تسری یک مصوبه به گذشته اگر حقوق مشمولان مصوبه که ناشی از یک قرارداد صحیح می‌باشد را نقض کرده و در حالی که هیچ شرط قبلی مبنی بر پرداخت مابه‌التفاوت یک نرخ در گذشته و حال حاضر وجود نداشته باشد، آنان را ملزم به پرداخت این مابه‌التفاوت کند؛ خلاف شرع است.
