Дать оценку сложившейся ситуации должна военная прокуратура, пояснил руководитель юридической компании "Аргумент" Дмитрий Качан.
По его словам, если контракт с Абушаевым был заключен до возбуждения уголовного дела и до объявления его в федеральный розыск, то противоречий законодательству нет. В этом случае уголовное дело может быть приостановлено до возвращения Абушаева из зоны СВО.
"А вот если контракт был заключен после возбуждения уголовного дела, такие действия противоречат ч. 2 п. 6 приказа министра обороны РФ от 15.02.2023 №67, в котором четко указано, что заявление о вступление в добровольческий отряд должно быть возвращено заявителю в случае "ведения в отношении кандидата дознания, предварительного следствия или передачи уголовного дела в суд, вынесения в отношении него обвинительного приговора и назначения наказания", - пояснил юрист.
