Він перебував під цілодобовим домашнім арештом до 23 грудня включно. 6 січня суд у Дніпрі мав переобрати Тищенку запобіжний захід, та засідання перенесли на 10 січня через те, що захист депутата клопотав про відвід судді.
До того Тищенко двічі проігнорував вимогу суду прибути на засідання.
