Under the Sebi Act, the regulator has the power to carry out search and seizure of books, registers, documents including electronics and digital devices from any person associated with the securities market. In December 2021, Sebi officials had conducted a search and seizure operation at the premises of certain persons carrying out similar manipulative activities through Telegram channels. Additionally, investors are often instructed to deposit monies into personal bank accounts of individuals who claim to represent a legitimate entity, and/or into an unrelated corporate account. To lend credence and to lure unsuspecting victims, perpetrators usually claim that their entity and/or the investment schemes are approved by financial authorities. As such, the SC would like to remind investors to always exercise caution when evaluating investment opportunities, especially those promising unrealistically high returns with little or no risk. Investors should also never deposit money into someone’s personal bank account if instructed. Channels are not fully encrypted, end-to-end. All communications on a Telegram channel can be seen by anyone on the channel and are also visible to Telegram. Telegram may be asked by a government to hand over the communications from a channel. Telegram has a history of standing up to Russian government requests for data, but how comfortable you are relying on that history to predict future behavior is up to you. Because Telegram has this data, it may also be stolen by hackers or leaked by an internal employee.
