Верховный Суд РФ в Определении от 29.10.2024 №305-ЭС24-14412 по делу №А41-94292/23 указал, что раздельная продажа в рамках дела о банкротстве принадлежащих цеденту-должнику прав требования взысканных судом основной задолженности и неустойки в фиксированной сумме на определенную дату, не свидетельствует, если это не оговорено в договоре, об отказе цедента от уступки вместе с требованием основного долга права требования неустойки за период, следующий за указанной датой.
