Водитель оплатил парковку с опозданием на 2 минуты и получил штраф 5000₽.
Второй кассационный суд общей юрисдикции установил, что незначительная задержка оплатыможет считаться малозначительным нарушением, в связи с чем нарушитель может быть освобожден от наказания.
📱 У водителя может затормозить телефон, разрядиться батарея или пропасть связь – все это может считаться уважительной причиной опоздания, так как действия водителя при этом не несут негативных последствий для общества, а парковка все же оплачена.
Решение теперь могут принимать суды нижестоящих инстанций во всех регионах страны.
