ВС РФ будет разбираться, насколько корректны выводы судов, которые признали трансформаторную подстанцию недвижимостью.
Суд прислушался к доводам заявителей (конкурсный управляющий ООО СП «Аркаим», Банк ВТБ, БМ-Банк, ООО «Новый лес», АО «Нью Форест Про»), которые оспаривают акты судов апелляционной и кассационной инстанции.
Заявители не согласны с выводом судов о том, что трансформаторная подстанция обладает признаками недвижимого имущества (является неотъемлемой частью здания) лишь по факту монтажа оборудования в специально возведенном для его эксплуатации месте, а также в связи с тем, что последующий демонтаж и перемещение оборудования потребует несения дополнительных затрат.
Дело № А73-513/2023 передано на рассмотрение Судебной коллегии по экономическим спорам и будет рассмотрено 02.10.2024.
